
A common misconception is that Physicians and Lawyers are at odds over issues related to liability insurance in medical liability cases. Unfortunately, this is a false concept, often fostered by insurance companies themselves. In fact, nothing could be further from the truth. Most Doctors and other health care professionals enter their chosen professions with the intent to "do no harm," and very much want to contribute to the well-being of their patients and all of society. Most purchase medical liability insurance to protect their interests in the event a claim is made against them. Sometimes, their interests conflict with the interests of the insurance company. When that occurs, the Physician or health care provider may need separate representation to help make sure that the insurance company acts in the best interest of its insured and not just in its own best interests.
Unfortunately, some health care providers make serious mistakes, costing their patients undue pain, suffering and sometimes, death. If their actions are the result of negligence or gross misconduct, the victim or his or her family may be due just compensation. In some cases, Physicians, Medical Facilities and other health care professionals have recognized their mistake, and would like to come to a fair and equitable agreement with the injured party. However, some stubbornly litigious insurance companies often put up a fight, hoping to avoid having to make any reasonable payment to the claimant, or even denying to provide some of the insurance policy coverages to their insureds altogether. Tragically, this not only causes increased hardship for the injured party, but also puts the Physician or health care professional in the place of having to be sued as a Defendant in a civil action thus placing their assets and livelihood at risk.
